NEW POSSIBILITIES PROGRAMME REGULATIONS

Version no. 1 effective since 1 September 2021

  1. GENERAL INFORMATION
    1. These Regulations define general terms of eligibility for the Programme. Notions started with capital letters are defined in item 2 hereof. 
    2. The Programme is organized on its own behalf by Telmedicin sp. z o.o. with its registered office in Warsaw at 2, Biały Kamień Street, postal code 02-593, Warsaw, entered into the Register of Companies of the National Court Register kept by the District Court for the capital city of Warsaw, 13th Economic Division of the National Court Register under NCR no. 0000516452, TIN: 5272720484. 
    3. Under the Programme, Telmedicin makes a public commitment within the meaning of article 919 of the Act of 23 April 1964 – Civil Code (consolidated text in the Journal of Laws of 2020, item 1740, as amended) to grant to the Beneficiary Benefits for performance of determined activities on terms defined in the Regulations. 
  2. DEFINITIONS
    1. Declaration – declaration of selection of a primary care general practitioner, nurse or obstetrician, submitted via the Platform or directly at the Partner’s registered office. 
    2. Candidate – natural person with a full legal capacity eligible for the Programme, 
    3. Civil Code – Act of 23 April 1964 – Civil Code (consolidated text in the Journal of Laws of 2020, item 1740, as amended);
    4. Programme – public commitment organized by Telmedicin under the name of New Possibilities. 
    5. Beneficiary – participant of the Programme, entitled to benefit from the Package who meets the conditions set herein. 
    6. Partner – Przychodnia 24 sp. z o.o. with its registered office in Warsaw,  at 2, Biały Kamień Street, postal code 02-593, entered into the Register of Companies of the National Court Register, kept by the Register of Companies for the capital city of Warsaw, 13th Economic Division of the National Court Register under NCR no. 0000877714, TIN: 5213917268, REGON: 387930851. 
    7. Package – E-visits provided by a general practitioner/physician from  Telmedicin and E-visits provided by a general practitioner/physician from Telmedicin in order to discuss the results of tests and exams requested by the general practitioner/physician from Telmedicin referred to in the Services Regulations which can be viewed at https://telemedi.com/pl/regulamin/, which the Beneficiary is entitled to under the Programme
    8. Profile – individual and authorized account on the Platform. 
    9. Platform – application available at www.telemedi.co and its subdomains or as an application for mobile devices which makes part of an ICT system. 
    10. Regulations – these Programme Regulations. 
    11. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.
    12. Telmedicin – Telmedicin sp. z o.o. with its registered office in Warsaw at 2, Biały Kamień Street, postal code 02-593, Warsaw, entered into the Register of Companies of the National Court Register kept by the District Court for the capital city of Warsaw, 13th Economic Division of the National Court Register under NCR no. 0000516452, TIN: 5272720484. 
  3. TERMS OF ADHERENCE TO THE PROGRAMME AND OF USING THE PACKAGE 
    1. The Programme enables the Candidates to acquire the right to benefit from the Package. In order to adhere to the Programme, be granted the status of the Beneficiary and the right to benefit from the Package, a Candidate should meet the following conditions: 
      1. Familiarize themselves with the Regulations and accept them; 
      2. Submit their Declaration to the Partner via the Platform or at the Partner’s registered office; 
      3. Sign with Telmedicin an agreement of access to the Profile as regulated at: https://telemedi.com/pl/regulamin/.
    2. The Beneficiary shall be entitled to benefit from the Package throughout the validity of the Declaration and validity of the Beneficiary’s health insurance. 
    3. The Package encompasses consultations by a general practitioner/physician from Telmedicin and consultations of results of the tests requested by the general practitioner/physician from Telmedicin. 
    4. Should the Beneficiary abuse their access to the Package and participate in or fix E-Visits they are not entitled to, Telmedicin reserves the right to limit the number of E-Visits to which they are entitled to. 
  4. PERSONAL DATA PROTECTION
    1. The controller of the Beneficiary’s personal data is Telmedicin sp. z o.o. with its registered office in Warsaw at 2, Biały Kamień Street, postal code 02-593, Warsaw, entered into the Register of Companies of the National Court Register kept by the District Court for the capital city of Warsaw, 13th Economic Division of the National Court Register under NCR no. 0000516452, TIN: 5272720484.  
    2. Personal data shall be processed for the following purposes: 
      1. Organization and implementation of the Programme, including acceptance of submissions by Candidates and verification of their entitlement to benefit from the Package according to the Regulations; 
      2. Granting the Candidates the access to the Package;
      3. Handling of Programme-related complaints;
      4. Health prevention or occupational medicine, medical diagnosis, medical care assurance, treatment or management of medical care services. 
    3. Legal grounds of personal data processing are as follows: 
      1. article 6 item 1 letter c) GDPR, that is compliance with a legal obligation to which the controller is subject under the accounting, tax and public commitment provisions arising from the Civil Code; 
      2. article 6 item 1 letter f) GDPR, that is legitimate interests pursued by the controller consisting in the organization and implementation of the Programme;
      3. article 6 item 1 letter f) GDPR, that is legitimate interests pursued by the controller consisting in the possibility to determine and raise by Telmedicin determined claims and defend themselves against any claims arising from the Programme; 
      4. article 9 item 2 letter h) GDPR in relation with the provisions regulating the process of providing medical services.  
    4. A data subject has the following rights: 
      1. The right of access to their personal data and to be informed about their processing and, should they be inaccurate, the right to their rectification (pursuant to article 15 and 16 GDPR);
      2. The right to restriction of data processing in the cases and under the terms defined in article 18 GDPR; 
      3. The right to request data erasure pursuant to article 17 GDPR (“right to be forgotten”); 
      4. Right to object at any given moment. 
    5. General personal data processing terms are specified in Telmedicin’s privacy policy which can be found at https://telemedi.co/pl/page/polityka-prywatnosci.
    6. Notwithstanding the above, the Partner can also be the controller of personal data included in the Declaration. 
  5. COMPLAINTS
    1. Any complaints on the way the Programme is implemented should be lodged by phone to 48 22 357 49 49  or by e-mail at [email protected]  or in writing to Telmedicin’s address.
    2. It is recommended for the complainant to include in their complaint: (1) information and circumstances on the subject-matter of the complaint, including type and date of occurrence of the irregularity; (2) the complainant’s claims, which can make it easier and faster for Telmedicin to handle the complaint. The requirements provided in the precedent sentence are a recommendation only and they do not affect the effectiveness of the complaints submitted outside of the recommended complaint description. 
    3. All the complaints related to the performance of services by Telmedicin should be lodged by phone to 48 22 357 49 49   or by e-mail to [email protected]  or in writing to Telmedicin’s address
    4. It is recommended for the Beneficiary to include in their complaint description: (1) information and circumstances on the subject-matter of the complaint, including type and date of occurrence of the irregularity; (2) the complainant’s claims, and (3) the complainant’s contact details– which can make it easier and faster for Telmedicin to handle the complaint. The requirements provided in the precedent sentence are a recommendation only and they do not affect the effectiveness of the complaints submitted outside of the recommended complaint description.
    5. Complaints which do not need to be completed shall be handled within 14 days of their receipt. Telmedicin shall inform the complainant about the handling method via the communication method with which the complaint was lodged. 
    6. Should it be necessary to complete the complaint, Telmedicin shall immediately, no later, however, than within 14 days following its submission, inform the complainant about it. In such a case the time frame referred to in item 5.5. above shall be calculated starting on the day on which the complaint is completed. 
  6. AMENDMENTS OF THE REGULATIONS
    1. These Regulations can be viewed on the Platform. 
    2. Telmedicin reserves the right to amend these Regulations for vital reasons. Vital reasons should be interpreted first and foremost as changes in the technical solutions adopted, amendments of the legislation in force, changes in the interpretation or practice of public administration bodies. Any such changes shall be reported to the Beneficiary by e-mail to the e-mail address assigned to the Profile. The amended Regulations and information on their changes can also be viewed on the Platform. 
    3. Changes in the Regulations shall enter in force after 5 days following notifications of the changes sent to the Beneficiaries. The exact effective date shall be specified in the respective notification sent to the Beneficiary each time a change is adopted. 
  7. MISCELLANEOUS
    1. Terms of providing e-services by Telmedicin shall be defined in the e-services regulations which can be viewed at https://telemedi.com/pl/regulamin/.
    2. To any matters not settled herein the general provisions of the Polish legislation shall apply. 
    3. Telmedicin reserves the right to end the Programme at any given time. It shall notify the Beneficiaries of it via the Platform.
